Job Title: Attorney - Office of Data Privacy

Location: New York, NY

The Agency is seeking full-time contract attorneys for a 6+ month assignment, with potential for long-term extension.

Overview:

The Office of Data Privacy (ODP) provides legal counsel to programs on a wide range of legal work impacting privacy and confidentiality and is responsible for ensuring agency-wide compliance with federal, state, and local laws and regulations governing privacy and confidentiality. ODP works closely with agency programs, units, and offices across the agency, and is routinely consulted by executive staff and senior leadership on an array of privacy-related questions and issues, often on a time-sensitive basis. Thus, ODP has an expansive portfolio involving extensive legal, administrative, and policy responsibilities both within and outside of the ODP.

Furthermore, ODP s duties and responsibilities have expanded significantly in recent years, making an additional attorney line an ever-increasing, critical need. Three recent developments have significantly increased ODP s workload and have made the additional attorney line a necessity for ODP:

  • The recent migrant crisis that has impacted New York City over the course of the last year and a half;
  • The increasing number of third-party data security incidents and the need for more data security-related legal support and counseling, especially in the area of Artificial Intelligence (AI); and
  • The additional compliance requirements imposed by the NYC Identifying Information Law and the citywide policies and protocols.

Recently, there has been an increase in the demand for data sharing agreements needed to support the response operations related to the influx of migrants to the New York City. There has also been an increase in third-party data security incidents that justify the need for an additional attorney to assist in managing these investigations and providing legal counsel.

ODP is expected to provide time-sensitive legal opinions on complex issues, manage the day-to-day needs and operations of the ODP and its attorneys, opine on broader policy questions and initiatives, and ensure that the agency is in compliance with privacy and confidentiality laws and regulations while also doing what is necessary to best serve applicants and clients. This expansive portfolio and the additional duties imposed on ODP justify the hiring of an additional contract attorney.

ODP has a critical need to hire a contract attorney to assist with these tasks and duties, including but not limited to performing legal analysis/research, reviewing data requests, drafting legal opinions, reviewing and drafting data sharing agreements, reviewing policies and procedures, and investigating data security incidents.

Compensation:

$49.00/hour for 1-7 years of experience

$52.00/hour for 7+ years of experience
